By using the Site or placing an order with us, you confirm that you have read, understood, and agree to be bound by these Terms.

2. Eligibility

You represent and warrant that:

  2. You have the legal capacity and authority to enter into binding agreements.

4. Market Risk and Price Volatility

Precious metals markets can be highly volatile. Prices can move quickly and unexpectedly based on global economic conditions, currency changes, interest rates, geopolitical events, and other factors beyond our control.

By buying, selling, or holding precious metals, you acknowledge and agree that:

  1. You may experience substantial gains or losses.

5. Product Information & Availability

We strive to provide accurate descriptions, images, and specifications for all Products. However:

  • Product images may be representative and may not show the exact bar, coin, or serial number you receive.
  • We may source Products from a variety of domestic and international mints, refiners, depositories, and wholesale suppliers.
  • All orders are subject to availability. If a Product is unavailable after you place an order, we may:
    • Offer a comparable substitute,
    • Offer a partial shipment, or
    • Cancel all or part of the order and refund the affected portion.

6. Pricing and Spot Price Changes

Prices displayed on the Site are based on live or near-live precious metals market data and are subject to change without notice.

When you place an order:

  1. The price you see is typically locked in at the time your order is submitted and accepted by us.
  2. We reserve the right to:
    • Reject or cancel any order due to pricing errors, typographical errors, or system failures,
    • Cancel orders affected by sudden, extreme market disruptions or obvious mistakes (e.g., clearly incorrect prices).

If we cancel an order after you have submitted payment, we will refund the amount paid for the cancelled portion, subject to any applicable fees as described in these Terms and permitted by law.

7. Orders, Acceptance, and Cancellations

Your order is an offer to buy. We are not obligated to sell to you until we:

  1. Receive your order,
  2. Confirm the order (e.g., by email or on-screen confirmation), and
  3. Receive and verify your payment within the required time.

We may cancel or refuse any order, at our discretion and where permitted by law, including but not limited to:

  • Suspected fraud or suspicious activity,
  • Failure to provide requested identification or documents,
  • Non-payment or late payment,
  • Errors in pricing or product information,
  • Market conditions that make the transaction commercially unreasonable.

Once an order is confirmed and payment is locked, many bullion dealers treat orders as final and non-cancelable, due to market risk. Our ability to cancel and any restocking or market loss fees will follow the policies described on the Site and in these Terms and will comply with applicable law.

8. Payment Terms

We may offer various payment methods (such as bank wire, ACH, credit/debit card, or other methods listed on the Site). By selecting a method, you agree to follow all related instructions and time limits.

You agree that:

  1. You will not initiate chargebacks or payment disputes without a legitimate basis.
  2. If a payment is reversed, rejected, or fails, we may:
    • Cancel your order, and
    • Charge you market loss, restocking, or administrative fees, where permitted by law.

9. Shipping, Handling & Risk of Loss

Shipping options, fees, and estimated delivery times are described on the Site or at checkout.

Unless otherwise stated in writing:

  1. We may ship directly from our own inventory or from third-party vaults, refiners, or suppliers.
  2. Risk of loss and title to the Products typically pass to you when the carrier records the package as delivered to the shipping address you provided.
  3. You are responsible for providing a secure delivery location and promptly inspecting packages upon arrival.

If a package is reported lost or damaged in transit:

  • You must notify us in writing within the time frame stated on the Site.
  • We may file a claim with the carrier and/or insurer.
  • Replacement or refund is subject to investigation and carrier/insurer decisions, and to any limitations described in these Terms.

10. Storage, Drop-Shipments & Third-Party Services

In some cases, Products may be held, shipped, or fulfilled by independent custodians, depositories, refiners, or logistics providers.

You acknowledge that:

  1. Such third parties are independent of Absolute Bullion.
  2. We are not responsible for acts or omissions of those third parties except as required by law or expressly stated in a separate written agreement.

If you use any storage or shipping services linked or recommended by us, your relationship with those third parties will be governed by their separate terms and conditions.

11. Returns, Exchanges & Buybacks

Due to the nature of precious metals and market volatility, many bullion transactions are final and not eligible for returns, exchanges, or refunds, except where required by law or explicitly stated in our policies.

If we offer buyback or repurchase options:

  • We may buy Products back at our then-current bid price, which may be higher or lower than your original purchase price.
  • Buyback is at our discretion and is not guaranteed.

Details of any return, exchange, or buyback program will be described on the Site and may change at any time.

12. Compliance, KYC, and Anti-Money Laundering

We are committed to responsible business practices and compliance with applicable anti-money-laundering (AML), sanctions, and other laws.

You agree that we may:

  1. Request identification and supporting documents to verify your identity, source of funds, and/or purpose of purchase.
  2. Refuse, pause, or cancel any order or account if:
    • You fail to provide requested information, or
    • We believe that doing so is required to comply with law or our internal policies.

We may report suspicious or large transactions to government authorities where required.

13. Taxes and Reporting

You are solely responsible for:

  • Determining any tax obligations (income, capital gains, sales, use, VAT, duties, etc.),
  • Filing any required reports, and
  • Paying any taxes related to your bullion transactions.

We may be required by law to:

  • Collect certain taxes at checkout, and/or
  • File informational reports with tax authorities regarding specific transactions.

18. Force Majeure

  • Acts of God, natural disasters, pandemics, or epidemics,
  • War, terrorism, civil unrest, or government actions,
  • Labor disputes, supply chain disruptions, or failures of carriers or third-party service providers,
  • Power outages, internet or communication failures, or system breakdowns.
